This Domain Name Agreement (“Agreement” or “Terms”) outlines the conditions for utilizing any domain name-related services offered by RoyalSonic Hosting Ltd. (“RoyalSonic”, “us”, “our”) as a reseller. These services include, but are not limited to, domain name registration, domain name transfer, and domain name ID protection (“Services”). The terms “you”, “your”, or “customer” refer to any individual or entity that accepts this Agreement electronically and/or utilizes the Services.
This Agreement is a fundamental component of the RoyalSonic Terms of Service (“TOS”) and, along with the Registrant Agreements and ICANN’s Uniform Domain Name Dispute Resolution Policy (detailed in Appendix A), as well as the relevant Registry policies, constitutes the complete Agreement between you and RoyalSonic regarding your use of the Services.
By purchasing a Service, you affirm that you have read, understood, and agree to comply with these Terms. RoyalSonic disclaims any responsibility for domain names associated with our Services that are not managed through us (including those registered or transferred to RoyalSonic).
Domain Name Registration and Management
You may acquire a domain name registration for a top-level domain name (“TLD”)—which includes generic top-level domains (“gTLD”) and country-specific top-level domains (“ccTLD”)—by submitting an Order to RoyalSonic. At the time of placing your Order, we cannot assure that the domain name requested will be registered in your name or is eligible for registration. You should not assume that your Order guarantees the registration of a domain name until we provide you with confirmation that your domain has been successfully registered.
The registration and utilization of a domain name are governed by the applicable terms and conditions set forth by the relevant Registrar/Registry, which are incorporated herein by reference. In the event of any conflict between this Domain Name Agreement and the terms and conditions of the applicable Registrar/Registry, the latter shall take precedence. You acknowledge and accept that RoyalSonic is not liable if a Registrar/Registry declines to register a domain name.
Should you register a domain name through RoyalSonic or transfer a domain to us, you will have the ability to manage the domain via your Client Area.
Domain names and associated services are subject to renewal and termination as outlined in the RoyalSonic Terms of Service. Please note that domain registration and renewal fees are non-refundable under any circumstances. The maximum renewal duration for various TLDs may differ based on the respective Registry’s policies. Renewal fees for expired domain names may also vary according to the rules established by the Registrar of record
Registrant Information
During the registration process, you are required to provide specific information to us. We will handle this information in accordance with our Privacy Policy. The details necessary for processing your domain name registration are specified in your Order. By submitting an Order for domain name registration or renewal, you affirm that all information and any supporting documentation provided for the registration or renewal of the domain name are accurate, complete, and not misleading in any respect, and that the Order is submitted in good faith. You further affirm that you meet and will continue to meet (for the duration of the domain name registration) any eligibility criteria as stipulated in the registry policies.
By providing us with information regarding a third party, you affirm that you possess the authority to commit that third party to these Terms and have obtained their explicit prior consent for the disclosure and utilization of their information as outlined in our Privacy Policy.
Certain Registries mandate that you verify your contact information following initial registration and/or any changes to your contact details before the completion or update of a domain name registration. If this requirement applies to your domain, either RoyalSonic or the designated Registrar will send you an email with instructions for confirming your information. Failure to confirm your details within the designated timeframe may result in the suspension or deletion of your domain, impacting the functionality of any associated Services. You are fully responsible for adhering to any instructions provided to maintain your domain name registration in good standing.
You recognize and accept that the information required for domain name renewal may change. If you do not supply the updated information, your registration will not be renewed.
The information you provide establishes the domain name holder (domain registrant). For domain names that are not expired and registered through RoyalSonic, and subject to availability and the requirements of the relevant Registry, this information can be modified through your Client Area. You acknowledge and agree that as a domain name registrant, you are granted an exclusive right to utilize a domain name for a specified period. However, the registration of a domain name does not confer any proprietary rights to you or any other party.
You are entirely responsible for supplying us with accurate and current contact information, and you must promptly update it as necessary to ensure it remains complete and precise. We will not be liable for any cancellation or refusal to renew a domain name by the relevant Registrar/Registry resulting from your failure to provide such information. Any modifications to your domain name contact details made through the RoyalSonic Client Area are your responsibility.
You acknowledge and agree that if you (i) provide incorrect information; (ii) do not update your contact information in a timely manner; or (iii) fail to respond to inquiries from RoyalSonic or the Registrar regarding the accuracy of your domain name contact details within the specified timeframe, this will be considered a breach of these Terms and may lead to the suspension or termination of the Service.
Collection and use of registration information
By registering a domain name through or transferring a domain to RoyalSonic, you understand and agree that the Registrar of record, the relevant Registry, or ICANN may set forth guidelines, limits, and/or requirements concerning the information we must collect from you to provide our Services and how we may utilize that information.
You acknowledge and agree that RoyalSonic will share the domain name registration information you provide, or that RoyalSonic otherwise holds, with ICANN, the Registrar of record, the Registry, and other third parties as required or permitted by ICANN and applicable laws. You hereby give your explicit consent for the collection, use, and disclosure of domain name registration information as outlined in this Agreement.
Domain Transfers (Registrar)
You have the option to change the Registrar of record for an existing domain name in compliance with the transfer policies and requirements established by the relevant Registry. Only the individual or entity designated as the registrant in the current domain name registration (“Domain Name Holder”) is authorized to initiate a transfer request to RoyalSonic. By acquiring domain transfer services from us, you affirm that you are the Domain Name Holder or that you have received proper authorization from the Domain Name Holder to proceed with the transfer.
The necessary information to initiate a domain name transfer will be gathered through the corresponding Order form. We may require you to provide additional documentation to verify your status as the Domain Name Holder either before or after the transfer request is submitted. If the Registrant of record is being changed from one party to another, we may also ask for appropriate authorization for the transfer, such as a mutual agreement between the parties, a final ruling from a binding dispute resolution body, a court order, or other suitable authorization.
Once the Registrar transfer request is successfully completed, our Registrar will immediately take over as the Registrar of record.
You acknowledge and accept that any domain name transfer is governed by the terms and conditions established by the respective Registry. RoyalSonic will not be held responsible for transferring domains that do not fulfill the transfer requirements of the relevant Registry.
ID Protect Services
If specified in your Order and subject to availability, we will offer private domain name registration services (ID Protect). Should we provide ID Protect Services, you acknowledge and agree that this service is provided as per the terms of the respective Registrar, and RoyalSonic will not be liable for any inadvertent disclosure of your identity.
By acquiring ID Protect Services from us, you acknowledge that (i) your utilization of the Services must adhere to the terms and conditions outlined in the RoyalSonic Terms of Service; (ii) you are responsible for ensuring that your domain name contact information remains accurate and current; (iii) you must not utilize the Services to circumvent any legal, registry, ICANN, or other obligations or regulations; (iv) you are required to promptly respond to any notifications we or the domain name Registrar may send you as a consequence of your use of ID Protect Services.
Customer Responsibility. Disputes
You are entirely accountable for: (i) managing the domain in strict accordance with this Agreement and our Terms of Service, even if the domain is registered to or maintained by a third party; (ii) supplying any additional information and documentation requested by us and/or the Registrar of record; and (iii) keeping track of the notifications sent to the administrative email address associated with your Customer Account and the administrative email address of the domain name(s) you have registered. Neglecting any of your responsibilities may lead to the suspension or termination of the Service.
Any disagreements between you and any third party concerning a domain name must be settled directly between the involved parties. RoyalSonic will not participate in any disputes nor will it assist in dispute resolution. We reserve the right, upon becoming aware of a dispute and at our sole discretion, to delete the domain name (if feasible), disable its automatic renewal, and/or make appropriate representations to the Registrar of record or the relevant Registry. Disputes regarding the registration and use of domain names will be governed by ICANN’s Uniform Domain Name Dispute Resolution Policy.
